Our dealership ("we", "us", "our") operates this website and customer portal (the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect your personal data in accordance with the Data Protection Act, 2019 (Laws of Kenya) and the regulations made under it. By using the Service, you consent to the practices described in this policy.

2. Personal Data We Collect

Depending on how you use the Service, we may collect:

• Identity data: full name, national ID or professional ID number, username.
• Contact data: phone number, email address, physical/postal address.
• Account data: login credentials (passwords are stored as one-way cryptographic hashes - we never store or can retrieve your actual password), account status, and role.
• Vehicle & Hire-Purchase (HP) data: vehicle registration/stock reference, HP agreement number, deposit, installment schedule, payment and balance history, and related documents you upload (e.g. proof of payment).
• Transaction data: quotations you request, vehicles you reserve, orders and invoices linked to your account.
• Technical data: IP address and basic request metadata, collected automatically for security purposes such as rate-limiting login and password-reset attempts.
• Communications: messages you send us through the portal's messaging feature.

3. How We Use Your Data

We process your personal data on the legal bases of contract performance, legal obligation, and consent, in order to:

• Create and administer your customer account and verify your identity, including HP customer login using your vehicle registration number and national/professional ID;
• Administer your Hire-Purchase agreement, including generating and providing statements, tracking installments and payments, and sending payment reminders;
• Process vehicle quotation requests and reservations, and communicate with you about them, including via WhatsApp when you choose to reserve a vehicle;
• Respond to enquiries and messages you send us;
• Maintain the security of your account and our systems, including detecting and preventing fraudulent login and password-reset attempts;
• Comply with our legal, tax, and regulatory obligations under Kenyan law.

4. Sharing Your Data

We do not sell your personal data. We share it only where necessary with:

• Our own internal accounting/dealership management system (Dolibarr), which is the system of record for your quotations, orders, invoices, and HP agreement;
• Regulatory or law enforcement authorities, where we are legally required to do so;
• Professional advisers (e.g. auditors, legal counsel) under a duty of confidentiality, where necessary.

5. Data Retention

We retain your personal data for as long as your account remains active and for as long as necessary to fulfil the purposes described above, including any statutory retention periods required for financial and tax records under Kenyan law. When data is no longer needed, we take reasonable steps to delete or anonymise it.

6. Data Security

We apply technical and organisational measures to protect your data, including: passwords stored as salted cryptographic hashes (never in plain text); encryption of sensitive credentials at rest; role-based access controls restricting staff/administrator access to only what each role needs; and rate-limiting on authentication and password-reset endpoints to resist automated attacks. No system is completely secure, and we continuously work to improve these protections.

7. Your Rights Under the Data Protection Act, 2019

Subject to applicable law, you have the right to:

• Be informed of the use to which your personal data is to be put (as set out in this policy);
• Access your personal data that we hold about you - most of this is already visible to you directly in your account dashboard;
• Request correction of inaccurate or incomplete personal data (via your Profile settings, or by contacting us);
• Request deletion of your personal data, subject to our legal and legitimate business retention needs (e.g. active HP agreements or statutory financial records cannot be deleted while still legally required);
• Object to, or restrict, certain processing of your personal data;
• Lodge a complaint with the Office of the Data Protection Commissioner (ODPC), Kenya if you believe your data protection rights have been infringed.

8. Cookies & Local Storage

This Service uses your browser's local storage to keep you signed in between visits (storing a session token) and a session cookie for basic security purposes. We do not use third-party advertising or tracking cookies.

9. Children's Data

This Service is intended for use by adults capable of entering into a vehicle purchase or Hire-Purchase agreement. We do not knowingly collect personal data from children.

10. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. The "Last updated" date above will reflect the most recent revision.

These Terms of Service ("Terms") govern your use of the Our dealership website and customer portal (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About Us

Our dealership is a vehicle dealership based in Mombasa, Kenya, offering vehicle sales and flexible Hire-Purchase (HP) financing plans. Our contact details are set out below and at the foot of every page:

2. The Service

The Service lets you browse our vehicle listings, request quotations, reserve vehicles, and - if you are an existing Hire-Purchase customer - view your agreement details, installment schedule, and download statements. The Service is an information and communication tool; it does not itself constitute a binding contract of sale or of Hire-Purchase. A vehicle sale or HP agreement is only concluded once the relevant contractual documents have been formally signed by both parties, in person or through whatever channel we separately agree with you.

3. Account Registration & Security

• You must provide accurate, current, and complete information when registering and keep it up to date.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any suspected unauthorised access.
• Existing HP customers may log in using their vehicle registration number and national/professional ID as set out on the login page. Keep this ID information secure, as it doubles as your account password until you change it.
• We may suspend or terminate accounts that violate these Terms, provide false information, or are used for unlawful purposes.

4. Vehicle Listings & Pricing

We make reasonable efforts to keep vehicle listings, specifications, availability, and pricing accurate and up to date. However, vehicles may be sold, reserved, or have their pricing revised at any time without prior notice, and photographs are for illustrative purposes and may not depict the exact unit. We strongly recommend a physical inspection and test drive before finalising any purchase or HP agreement. Chassis and engine numbers are intentionally withheld from public listings and are only disclosed as part of the formal sale/HP documentation process.

5. Quotations & Reservations

Requesting a quotation or clicking "Reserve" through the Service expresses your interest and prompts our team to follow up with you (including via WhatsApp, where you provide or use that channel) - it is not a confirmed sale and does not itself hold a vehicle for an indefinite period. We reserve the right to decline, cancel, or reassign a reservation, for example where a vehicle has already been sold, at our reasonable discretion. Quotations you have not yet reserved can be withdrawn by you at any time from your account; once reserved, please contact us directly to make any changes.

6. Hire-Purchase Customers

For existing HP customers, the information shown in the portal (balances, installment status, statements) is provided for your convenience and reflects our records at the time of viewing. It does not replace, and is not a substitute for, the signed HP agreement and official invoices, which remain the governing documents of your agreement. If you notice a discrepancy, please contact us immediately so we can investigate.

7. Acceptable Use

You agree not to: attempt to gain unauthorised access to any account, system, or data; interfere with or disrupt the Service; upload unlawful, fraudulent, or infringing content; or use the Service for any purpose other than genuine vehicle-purchase or HP-related business with us.

8. Intellectual Property

All content on this Service - including text, graphics, logos, and the underlying software - is owned by or licensed to Our dealership and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from it without our prior written consent.

9. Limitation of Liability

To the fullest extent permitted under the Laws of Kenya, including the Consumer Protection Act, 2012, Our dealership shall not be liable for indirect, incidental, or consequential losses arising from your use of the Service, including temporary unavailability of the Service or inaccuracies in listing information, save that nothing in these Terms limits any right or remedy you have under mandatory Kenyan consumer protection law that cannot lawfully be excluded.

10. Privacy

Our collection and use of your personal data is governed by our Privacy Policy, which forms part of these Terms.

11. Governing Law & Disputes

These Terms are governed by the Laws of Kenya. Any dispute arising from your use of the Service or a related transaction shall first be addressed through good-faith discussion between you and us, and failing resolution, shall be subject to the exclusive jurisdiction of the courts of Kenya.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. The "Last updated" date above reflects the most recent revision.
